1. About PostGuard

PostGuard is operated by Elite Rose Digital. PostGuard provides AI-assisted compliance checking for social media posts created by FCA-regulated financial professionals.

PostGuard does NOT constitute legal or regulatory advice. PostGuard is a compliance assistance tool only. Users are solely responsible for all final compliance decisions. The tool assists but does not replace professional compliance review.

2. Eligibility

You must be 18 or older and based in the United Kingdom to use PostGuard. By creating an account, you confirm you meet these requirements.

3. Free trial and subscription

  • New users receive 3 free compliance checks with no credit card required.
  • After the free trial, continued access requires a subscription at £49 per month.
  • Subscriptions are billed monthly via Stripe. You can cancel at any time from your account settings.
  • Upon cancellation, you retain access until the end of your current billing period.
  • Refunds are handled on a case-by-case basis. Contact support@postguard.online for refund requests.

4. Acceptable use

You agree not to:

  • Use PostGuard for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or extract the AI models or prompts used by the service.
  • Share your account credentials with others.
  • Submit content that is illegal, abusive, or unrelated to financial promotions compliance.

5. Disclaimer of warranties

PostGuard is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that compliance checks will identify every potential issue.

AI-generated compliance analysis may contain inaccuracies. You must exercise your own professional judgement and seek independent compliance advice where appropriate.

6. Limitation of liability

To the maximum extent permitted by law, Elite Rose Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or regulatory fines, arising from your use of PostGuard.

Our total liability for any claim arising from these terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

7. Intellectual property

All content, branding, and technology comprising PostGuard are owned by Elite Rose Digital. You retain ownership of any text you submit for compliance checking.

8. Data and privacy

Your use of PostGuard is also governed by our Privacy Policy. By using the service, you consent to the collection and use of data as described therein.

9. Termination

We reserve the right to suspend or terminate your account if you breach these terms. You may close your account at any time by contacting support.

10. Changes to terms

We may update these terms from time to time. We will notify you of material changes by email. Continued use of PostGuard after changes constitutes acceptance of the updated terms.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
